EMPLOYEE FEED TERMS & CONDITIONS
Upon choosing ACCEPT, you agree to the terms of this contract between you ("participant") and THE HONEST KITCHEN, INC., ("THK") a Delaware corporation and its successors or assignees with its principal place of business at 111 14th Street, San Diego, CA 92101. The Honest Kitchen reserves the right to change the terms and conditions governing this program at any time at our discretion. THK is launching an Employee Feed Program ("THK Employee Feed") to increase brand awareness and drive trial of its products. Under the Employee Feed Program, the participant will qualify for discounted trial product, discount on THK products through the Employee Feed portal, early access to new products, and Employee Feed-only specials.
Participant Responsibilities
1. Confidentiality
We require that your participation in this program be kept confidential. Do not mention your benefits to other employees or customers. If clients or friends ask you about The Honest Kitchen please refer them to local retailer or our store locator online.
2. Payments/User Account
All sales are final. Please order carefully as we cannot accept returns/exchanges. Returns or exchanges at the retail locations are also not allowed. Purchases must be made with credit card only. No reward points may be used. We do not accept cash, money orders or checks. Prices are subject to change without notice. All employee orders must be shipped to their home address only. Only one ship to address will be allowed to prevent fraud. No orders will be shipped to the store location or PO Boxes. Shipments will only be made within the USA only. Keep your email address current. Accounts with e-mails returned as undeliverable will be closed.
3. Participant Discount
PURCHASES MADE THROUGH THIS PROGRAM ARE FOR PERSONAL USE ONLY AND NOT TO BE RESOLD, DOING SO WILL JEOPARDIZE YOUR ABILITY TO PARTICIPATE IN THIS PROGRAM. This program is reserved for employees at authorized retailers of The Hones Kitchen. We strictly prohibit the purchase of The Honest Kitchen for friends and family, and appreciate your respect for the integrity of the program. If in the duration of the program discounts to partner companies are offered, the same rules apply. We want to encourage you to take full advantage of this program, and to discover the benefits of feeding a whole food, human grade diet to your pets!
Maximum monthly order totals cannot exceed $250 (after the discount). Please make the shipping address your home address. Shipping address cannot be changed after first order without contacting The Honest Kitchen directly. Customers who receive discounted pricing, do not earn reward points on their purchases. Orders with Employee Feed discounted products do not qualify for any additional discounts, promotions or sales and are subject to applicable taxes and shipping fees.
4. Data Ownership
All information provided will be sole and exclusive property of THK.
5. Renewal
Annual renewal is required and participants may be required to submit a photo or scanned copy of their current paycheck stub (please black out $ and social security information) or business card.
6. Termination
Termination by THK. THK may terminate this Agreement at its convenience and without any breach by participant .
Termination by participant or store. The participant or store may terminate this Agreement at any time and participating employees will be removed from the program.
Any inactive accounts (accounts that have not placed an order within 90 days) will be subject to termination.
General Provisions Governing Law. This Agreement will be governed and construed in accordance with the laws of the State of California as applied to transactions taking place wholly within California between California residents. Participant hereby expressly consents to the personal jurisdiction of the state and federal courts located in San Diego, California for any lawsuit filed there against the participant by THK arising from or related to this Agreement.
Severability. In case any one or more of the provisions contained in this Agreement shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect the other provisions of this Agreement, and this Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein. If moreover, any one or more of the provisions contained in this Agreement shall for any reason be held to be excessively broad as to duration, geographical scope, activity or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with the applicable law as it shall then appear.
No Assignment. This Agreement may not be assigned by participant without THK’s consent, and any such attempted assignment shall be void and of no effect.
Entire Agreement. This Agreement is the final, complete and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and merges all prior discussions between THK and participant. No modification of or amendment to this Agreement, nor any waiver of any rights under this Agreement, will be effective unless in writing and signed by the party to be charged. The terms of this Agreement will govern all Project Assignments and services undertaken by the participant of THK Employee Feed.
